4.4 Cancellations and Refunds

Cancellation policies vary by service provider and booking type. Cancellation requests must be submitted according to the specific terms of your booking. Refunds, if applicable, will be processed according to the service provider's policy and may be subject to cancellation fees.

5. Prohibited Activities

7. Limitation of Liability

7.1 Service Disclaimer

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee uninterrupted, secure, or error-free service.

7.2 Third-Party Services

We are not responsible for the acts, errors, omissions, representations, warranties, or breaches of third-party service providers (airlines, hotels, tour operators, etc.). Your contractual relationship is directly with these providers.

7.3 Liability Cap

To the maximum extent permitted by law, Wanderlust Journeys shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

7.4 Force Majeure

We are not liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, strikes, government actions, or technical failures.

8. Privacy and Data Protection

Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect, process, and protect personal data in accordance with applicable data protection laws, including GDPR where applicable.

By using our services, you consent to the collection and use of information as described in our Privacy Policy.

9. Termination

9.1 Termination by User

You may terminate your account at any time by contacting us. Upon termination, your right to use our services will cease immediately.

9.2 Termination by Us

9.3 Effect of Termination

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Croatia, without regard to its conflict of law provisions.

Any disputes arising from or relating to these terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Croatia.

11. Dispute Resolution

11.1 Informal Resolution

In the event of any dispute, claim, or controversy, you agree to first contact us to attempt to resolve the issue informally. Please send a detailed description of your concern to our customer service team.

11.2 Mediation

If informal resolution fails, both parties agree to attempt resolution through mediation before pursuing formal legal action. Mediation shall be conducted in accordance with Croatian mediation procedures.

11.3 Litigation

If mediation is unsuccessful, disputes shall be resolved through litigation in the appropriate Croatian courts as specified in Section 10.

11.4 Class Action Waiver

You agree to resolve disputes on an individual basis and waive any right to participate in class actions or class arbitrations.

12. Indemnification

You agree to indemnify, defend, and hold harmless Wanderlust Journeys, its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney fees) arising from:

• Your use or misuse of our services
• Violation of these Terms and Conditions
• Violation of any rights of third parties
• Any content you submit or transmit through our services

13. General Provisions

13.1 Entire Agreement

These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Wanderlust Journeys regarding the use of our services.

13.2 Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these terms shall not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these terms or your rights hereunder without our prior written consent. We may assign our rights and obligations without restriction.

13.5 Third-Party Rights

These terms do not create any third-party beneficiary rights.

13.6 Language

These Terms and Conditions may be translated into other languages. In case of conflict, the English version shall prevail.
